Such clauses are ineffective, according to Hagge. The principle of proportionality applies in such cases, meaning milder measures such as warnings or partial suspensions are often sufficient.

Providers must clearly and easily explain in their GTC the rules for suspension, which could include late payment, misuse, security risks, or breach of contract. If a suspension occurs due to an event mentioned in the GTC, users should usually be informed and given the opportunity to respond.

However, arbitrary or unfair suspensions are prohibited. A complete block is only permitted if there is an immediate danger, such as suspected fraud. If a suspension occurs without a clear reason, consumers can challenge it. Hagge suggests filing an objection and setting a deadline for the provider to lift the suspension.

If the provider does not react, mediation bodies such as the Federal Network Agency, BaFin, or the European online dispute resolution platform can be contacted. In cases involving banks, like C24 Bank, consumers can contest account suspensions via complaints to BaFin or the Ombudsman.

To prevent or reverse account blocks, consumers should promptly provide requested documentation, maintain clear communication with the bank, and if necessary, escalate issues through regulatory bodies or seek legal advice. It's also important to keep evidence such as emails, screenshots, or chat logs to prove correct behavior in case of a dispute.
