Approval granted for reclassifying 'El Algarrobico' hotel land as 'non-developable' within the revised Municipal General Plan of Urbanism (PGOU) in Carboneras.
In the picturesque town of Carboneras, Almería, the Algarrobico Hotel has been a symbol of modern architecture and a subject of intense debate for many years. The hotel, initially conceived as an ecological establishment, has been embroiled in legal and environmental controversies since its construction began in 2003.
The construction of the Algarrobico Hotel was carried out without the appropriate permits, a fact that has been the basis for numerous legal challenges. The hotel's location within a protected natural space within the Cabo de Gata-Níjar Natural Park has further fuelled the controversy.
Recently, the Andalusian High Court (TSJA) ordered the El Algarrobico site to be classified as non-urbanizable land of special protection. This ruling requires the Carboneras Town Hall to cancel the urbanistic classification that allowed the construction of the Algarrobico Hotel.
In response to this ruling, the mayor of Carboneras has proposed seeking a "definitive solution through the expropriation of the hotel and its demolition," with the participation of the Andalusian Junta and the central government. The mayor defended the legality of the procedure, stating that the full council was "necessary" to complete the steps required by the court.
However, the municipal secretary's report warns of administrative anomalies and lack of essential documentation, leading to a context described as "absolute defenselessness" due to the accumulation of functions and lack of stable technical and legal staff in the Town Hall.
The socialist councillor Francisco Capel described the file as a "fraudulent maneuver." He has accused the mayor of not complying with judicial resolutions and has called on environmental groups to challenge the plenary agreement.
Ecologists will intervene in the review of the hotel's license file, recently initiated and ordered by the TSJA. The Carboneras Town Hall has also approved the partial modification of the General Urban Planning Plan (PGOU) to comply with the TSJA's ruling.
The Algarrobico Hotel has been a symbol of the fight for the conservation of the landscape and has generated an important debate about urbanism and sustainability in Spain. The Andalusian Supreme Court's decision on the Algarrobico hotel case in Carboneras has been pending, with announcements typically published in official bulletins shortly after rulings, but a specific date for this case's publication has not been confirmed.
The mayor has reiterated his commitment to fully complying with the sentences and ensuring a definitive solution to the Algarrobico Hotel issue. The future of the controversial hotel remains uncertain, but one thing is clear: the Algarrobico Hotel will continue to be a topic of interest and debate for many years to come.
