Arrest Warrants Enforced in Two Consecutive Days - Fines Instead of Jail Time for Three Individuals in BPOLI PW Case of GdpD POM
In recent events, two individuals from Poland and Ukraine have been apprehended by the Federal Police in Germany due to outstanding warrants for their arrest.
On September 27, a 31-year-old Ukrainian was stopped at the GUÜ Linken heading towards Löcknitz. The individual had a warrant for arrest issued by the LG Cottbus for the offence of smuggling aliens.
The following day, on September 28, a 36-year-old Pole was identified as a passenger in a car with Polish license plates at GUÜ Linken. The search revealed two warrants for arrest/execution of sentence for the Pole: one issued by the LG Hannover for violating the OWIG, and one issued by the LG Bremen for driving without a licence.
The Pole was able to avoid 45 days of substitute imprisonment for the LG Bremen warrant by paying 1,800.00 EUR and additional costs of 165.50 EUR. Similarly, the Pole was able to avoid 6 days of imprisonment for the LG Hannover warrant by paying 150.00 EUR and additional costs of 35.50 EUR.
The Federal Police Inspectorate Pasewalk with Joint German-Polish Station Pomellen, a federal authority as stated by the Federal Police Act and other laws, was instrumental in these apprehensions. The headquarters of this unit is located in Pomellen, Germany, and it is one of the operational units under the command of the Federal Police Directorate Bad Bramstedt.
The Federal Police Directorate Bad Bramstedt, responsible for tasks in Schleswig-Holstein, Mecklenburg-Vorpommern, and North and Baltic Sea, and beyond as needed, employs approximately 2,600 staff members, including police officers, administrative staff, and hourly wage employees.
The Directorate also has a maritime component, "Federal Police Sea", with Federal Police Inspectorates in Neustadt in Holstein, Warnemünde, and Cuxhaven. In addition to this, the Directorate has operational units in Flensburg, Kiel, Rostock, Stralsund, Pasewalk, and a Federal Police Inspectorate for Combating Crime in Rostock, as well as a Mobile Control and Surveillance Unit.
The Federal Police Inspectorate Pasewalk with Joint German-Polish Station Pomellen is part of the Directorate's efforts to monitor the sea border in the North and Baltic Sea (Schengen external border).

In a separate incident on September 28, a car with Polish license plates was stopped in Pomellen, and the driver was found to have a warrant for arrest/execution of sentence issued by the LG Osnabrück for driving without a licence. After paying a total fine of 2,151.00 EUR, the 36-year-old Pole was able to continue his journey.
The Pole was able to avoid a 25-day substitute imprisonment by paying 1,250.00 EUR and additional costs of 77.50 EUR. However, it was not disclosed who the head of the Federal Police Inspectorate Pasewalk with Joint German-Polish Station Pomellen is.
The Ukrainian, who was also found to have a one-handed knife during a search, which constitutes an administrative offence, was able to avoid a 45-day substitute imprisonment by paying 1,350.00 EUR and additional costs of 84.50 EUR.
