The ongoing legal dispute over the classification of the Alternative fΓΌr Deutschland (AfD) in the state of Hesse as a right-wing extremist party has been a topic of discussion lately. The dispute, currently under interim proceedings before the Higher Administrative Court of Hesse (VGH) in Kassel, has been a source of contention for several years.

In November 2023, the Administrative Court in Wiesbaden ruled that the Hesse AfD could be monitored by the state office for the protection of the constitution. However, a decision by the Federal Constitutional Court in Karlsruhe (not Kassel) regarding a potential ban on the AfD is not scheduled. It is important to note that the state of Hesse has not currently classified the AfD as a right-wing extremist party due to ongoing legal proceedings.

During the presentation of the 2024 Verfassungsschutz report in Wiesbaden, the call for legal clarity was made by Roman Poseck, the Interior Minister of Hesse (CDU). Poseck criticized the three-year-old classification of the AfD as a right-wing extremist suspect as still being in limbo. He urged for a prompt decision in the ongoing legal dispute.

Interestingly, the court has prohibited the office from reporting that the AfD was under observation. This decision has added another layer of complexity to the ongoing legal proceedings.

As the legal proceedings continue, the future classification of the AfD in Hesse remains uncertain. The public and the political landscape in Hesse will be closely watching the developments in this case.
