Individual Alleges Lasting Consequences Due to Defective Lighting in a Strip Hotel
In a recent development, David Van Horn, a former public school teacher from Newaygo County, Michigan, has filed a lawsuit against the Luxor casino resort on the Las Vegas Strip. The lawsuit, filed before the 8th Judicial District Circuit Court of Nevada, alleges negligence and the failure of the hotel to uphold its duty of care.
According to the lawsuit, the incident occurred on November 26, 2023, during a stay at the Luxor with his wife. The lawsuit asserts that Van Horn suffered a traumatic brain injury, a concussion, and an exacerbation of pre-existing PTSD, after he was shocked by a defective lamp post on the hotel premises. The shock caused him to hit his head, overturn a chair, and collapse to the floor.
The lawsuit further alleges that the hotel neglected to repair the faulty lamp or warn guests of the potential hazard, leading to Van Horn's injuries. His legal team argues that Luxor failed to ensure the safety of its premises.
This is not the first time a hotel or casino guest has filed a lawsuit against a resort in Nevada. In September 2024, Oyo Hotel & Casino Las Vegas visitors filed complaints with various Clark County departments over unreliable and inconsistent elevator service. Around the same time, Mississippi resident Krystal Nailer sued The STRAT Hotel, Casino & Tower in Las Vegas, claiming that bed bugs bit her during her stay in October 2022, resulting in permanent scarring.
In a separate case, US District Judge Karen Williams threw out a proposed class action in October, accusing Atlantic City hotels of driving up room prices via a shared revenue management system.
The two-count suit seeks monetary compensation to cover medical expenses, lost wages, and the long-term impacts of Van Horn's condition. The lawsuit is still ongoing, and as of now, there is no information available about the prosecutor or when the case against the Luxor Hotel will be heard.
The Luxor casino resort, owned by MGM Resorts International, has yet to comment on the matter. The incident serves as a reminder for hotels and casinos to prioritise the safety and well-being of their guests.
