The August 25, 1988, guidance, on the other hand, remains crucial for the use and enforcement of information requests and subpoenas. This guidance, which partially supersedes the guidance in the Memorandum issued in 1984, assists Regions in enforcing information request letters issued under sections 104 of CERCLA and 3007 of RCRA.

The Memorandum, issued under OSWER Directive No. 9834.4 on September 10, 1984, was the initial guidance. It provides guidance pertaining to the sections mentioned and was issued by the EPA to support Regions in enforcing information requests under these sections.
