Yoga instructor given notice for constructing yurt in backyard without proper building authorization
In the heart of Brighton and Hove, a tranquil oasis of peace and wellness has emerged, yet not without stirring up a bit of controversy. On May 25, 2024, Sacha Latham, a local yoga teacher, installed a yurt at the bottom of her garden to create a dedicated space for yoga practice, workshops, and even mini retreats.
However, the change of use from residential to business or commercial purposes, as the yurt is being used for potential yoga classes and retreats, typically requires planning consent. The yurt's installation without prior approval has necessitated a retrospective planning application, a fact highlighted by Simon Rix, a seasoned planning consultant and the founder of Planix.UK Planning Consultants Ltd.
The yurt, standing at 3.83 meters tall and supported by concrete posts on wooden decking, has become a focal point of controversy due to its oversized presence and potential safety risks. Locals have voiced strong concerns over its height, permanence, and potential hazards, questioning whether it was the right decision to allow such a structure in a very built-up area.
Neighbours may be concerned about potential noise, increased traffic, and changes to the character of the area due to the yurt's intended use. One resident stated that the yurt should have been applied for before its erection, expressing feelings of being overshadowed by the structure.
Ms Latham's plans for the yurt extend beyond yoga classes. She hopes to use it for healing circles and various retreats, aiming to create a sanctuary for wellness in the heart of the city. The council will have to weigh these aspirations against the concerns of the community.
Simon Rix, with a background in both local government and private consultancy, has pointed out that the need for retrospective planning permission indicates the yurt was built without approval. The council is currently reviewing the application, and a decision is yet to be made.
As the yurt continues to divide opinions, it serves as a reminder of the importance of planning consent in maintaining harmony between personal ambitions and community needs. The outcome of this case will undoubtedly set a precedent for future requests involving unconventional structures in residential areas.
